This bill creates a new offense in Tennessee law that makes it illegal to knowingly inhale, ingest, use, or possess any compound, liquid, gas, or chemical containing nitrous oxide, also known as "laughing gas," or amyl nitrite, commonly called "poppers" or "snappers." A violation of this law is considered a Class A misdemeanor, which is a serious misdemeanor offense, and the court may require offenders to participate in drug rehabilitation as a condition of probation. However, the bill outlines several exceptions, including when nitrous oxide is prescribed by a licensed medical or dental practitioner for treatment, used in manufacturing or industrial operations by individuals over 21, used as a propellant in food preparation for restaurants, or used for automotive purposes by individuals over 21. The bill also establishes that if nitrous oxide products are flavored or labeled as such, it creates a presumption that the exceptions do not apply. Furthermore, it prohibits any person or business, including online retailers, from producing, selling, or otherwise transferring nitrous oxide in violation of these provisions, with businesses facing suspension of their licenses for a first offense and revocation for a second offense. This act is set to take effect on July 1, 2026.
