This bill allows a municipality to initiate a property tax sale even if the outstanding taxes are less than the usual minimum of $1,500, provided the municipality obtains a court order confirming that the real property is abandoned and the dwelling on it is unfit for human habitation. To obtain this order, the municipality must file a complaint detailing the property owner, location, reasons for abandonment and unfitness, known creditors or interested parties, and the amount of delinquent taxes. After filing, a court hearing will be scheduled within 15 to 30 days. If the court grants the order, the municipality can proceed with the tax sale according to existing procedures, including notifying the delinquent taxpayer, any mortgagees or lien holders, and publishing notice of the sale. The bill also updates the allowable fees and costs associated with tax sales and specifies an effective date of July 1, 2026.
