This bill establishes procedures for gathering and preserving digital data related to complaints of federal agent misconduct, defining "federal agent" as a federal law enforcement officer or a private contractor assisting the Department of Homeland Security, and "federal agent misconduct" to include excessive force, assault, kidnapping, unlawful detention, or actions violating federal constitutional rights. Upon receiving such a complaint, the office of the attorney general or a county prosecuting attorney can instruct the Washington State Patrol to collect and securely store identifying digital data that could help confirm the identity of the federal agent involved, such as license plate, cell tower, cell phone, location, GPS, and facial recognition data. Complainants can only access this collected digital data relevant to their specific complaint if a court orders it in a civil case alleging a violation of federal constitutional rights or in a criminal case involving the federal agent.
