This bill, by adding Section 16-642.01 to Arizona Revised Statutes, mandates that any governing body responsible for canvassing (officially reviewing and verifying) an election must be granted access to all locations where election materials are created, handled, processed, tabulated, or stored before the canvass begins. This access includes election headquarters, tabulation centers, ballot storage facilities, early ballot processing sites, and any other locations designated for election activity by election administrators or the Secretary of State. The governing body's access rights encompass observing election procedures in person, examining and copying relevant documents and digital records, and receiving assistance from election officials to understand election materials. However, this access is limited to prevent disruption of the election, violation of voter privacy or ballot secrecy, and requires compliance with security and identification protocols. The bill also allows governing bodies to designate employees or agents to assist with these access activities, clarifies that it does not permit alteration or removal of election materials unless legally authorized, and provides for legal remedies, including court action and civil suits, for non-compliance, with violations classified as a class 2 misdemeanor. "Election materials" are broadly defined to include all items used in the administration, tabulation, or verification of an election.
