This bill declares an emergency due to the failure and permanent closure of the Fairfax bridge on state route number 165, which occurred on April 22, 2025, and directs the state department to restore access across the Carbon River as soon as possible. The Secretary of Transportation is granted emergency authority to expedite the planning and construction of the replacement bridge, allowing them to waive or suspend certain statutory obligations and limitations. These include requirements related to interlocal agreements, inspection fees owed to the Department of Labor and Industries, regulations from the Utilities and Transportation Commission, tax collection procedures, and other state agency rules or procedures if strict compliance would hinder necessary emergency actions, unless doing so would conflict with federal funding requirements or First Amendment rights. The Secretary must provide practical notice to the governor, legislative leadership, and local governments when issuing emergency orders, and activities under this bill are exempt from Executive Order 25-07. The bill takes effect immediately because it is deemed necessary for the preservation of public peace, health, and safety.
