Bill Summary

As introduced, prohibits the division from providing coverage or reimbursement for a medical procedure performed on, or administered to, an individual if the performance or administration of the procedure is for the purpose of enabling the individual to identify with, or live as, a purported identity inconsistent with the individual's sex, or treat purported discomfort or distress from a discordance between the individual's sex and asserted identity. - Amends TCA Title 71, Chapter 5.

AI Summary

This bill amends Tennessee law to prohibit the state's TennCare program from covering or reimbursing medical procedures, including surgeries and the prescription of puberty blockers or hormones, if the purpose is to help an individual identify with or live as a gender different from their sex assigned at birth, or to treat distress related to this discordance. The bill defines "sex" as immutable characteristics of the reproductive system determining male or female at birth, and explicitly excludes gender dysphoria and related conditions from being considered "diseases" for the purpose of medical exceptions. However, TennCare would still cover procedures for congenital defects, precocious puberty, disease, or physical injury, and would allow continued coverage for procedures that began before the bill's effective date of July 1, 2026, and conclude by March 31, 2027, provided a physician certifies that stopping the treatment would be harmful.
