This bill increases the maximum civil penalties for violations of New Mexico's water laws, specifically targeting violations related to the State Engineer's authority and the Ground Water Storage and Recovery Act. For general violations of water law, the maximum penalty is raised to $3,400 per day, with a higher penalty for selling water without a permit, which can be double the economic benefit or $25 per barrel sold, whichever is greater. Violations related to the illegal recovery or use of stored water under the Ground Water Storage and Recovery Act can now incur a penalty of up to $10,000 per day. Additionally, for breaches of bonds related to well licenses, the state engineer can seek a civil penalty of up to $10,000, determined by the district court, in addition to damages. These changes aim to provide stronger enforcement mechanisms for water resource management in the state.
