This bill amends Title 27 of the Pennsylvania Consolidated Statutes to establish new requirements for the decommissioning and repurposing of warehouses, which are defined as large facilities for storing and moving goods. The bill introduces a "decommissioning plan" that outlines how a warehouse will be dismantled and the property restored, and a "repurposing plan" for reusing an existing warehouse for a new purpose. Property owners will be required to submit these plans to the Department of Community and Economic Development (DCED), which is referred to as the "Department." A key provision requires property owners to provide "financial assurance," such as an escrow account or a letter of credit, to cover the estimated costs of decommissioning. This financial assurance will be phased in over 20 years from the start of construction, increasing from 10% to 100% of the estimated decommissioning cost, and will be payable to the Department if the owner fails to decommission the warehouse. If a property owner successfully gets a repurposing plan approved by the Department, the financial assurance requirements may be suspended or released, but the repurposing plan must include provisions for future decommissioning. The bill also specifies the content required for both decommissioning and repurposing plans, including municipal approvals for repurposing, and exempts warehouses smaller than 5,000 square feet from these requirements.
