Bill Summary

This act would provide for a cause of action against an individual or entity that prohibits the possession of firearms on real property, except residences, by an individual that is authorized and licensed to carry a firearm. The cause of action would allow the injured individual to recover for injury to his or her person, death, physical, emotional and/or mental distress, economic loss or expense, property damage or any other compensable loss as a result of conduct occurring on the real property that prohibits the possession of firearms. This act would take effect upon passage.

AI Summary

This bill establishes a new civil cause of action, allowing individuals who are authorized and licensed to carry a firearm to sue property owners for damages if they suffer harm, including injury, death, distress, economic loss, or property damage, on real property (excluding residences) that has a written notice prohibiting firearm possession. To win such a lawsuit, the injured person must prove they owned a firearm and were legally allowed to carry it, that they refrained from carrying it due to the posted prohibition, that their harm could have been avoided if they had been allowed to carry their firearm, and that the property owner posted the prohibition voluntarily and was not legally required to do so. The bill also clarifies that this cause of action extends to harms caused by others on the property, animals, or hazards, and sets a three-year statute of limitations for filing such lawsuits.
