Bill Summary

AN ACT to amend the executive law, in relation to prohibiting employers from engaging in discrimination on the basis of a protected class when using artificial intelligence in certain employment practices

AI Summary

This bill amends existing law to prohibit employers from using artificial intelligence (AI), defined as a machine-based system that generates predictions, content, recommendations, or decisions, including generative AI which can produce human-like text, images, or multimedia, in employment practices such as recruitment, hiring, promotion, or discharge if it results in discrimination against individuals based on protected classes like race, gender, age, or disability. Furthermore, employers will be required to notify employees when AI is being used for these employment purposes, and the relevant state division will establish rules for implementing and enforcing these notice requirements, with the law taking effect 180 days after it becomes law.
