AI Summary
This bill, known as the Mississippi Freedom Boater Law, restricts enforcement officers from the Mississippi Commission on Wildlife, Fisheries and Parks or the Department of Marine Resources from stopping or boarding a vessel solely for a safety inspection. Violations related to safety equipment will now be considered secondary offenses, meaning they can only be cited if the officer has already stopped the vessel for another reason. Officers must now have probable cause, meaning a reasonable belief that a primary offense (a more serious violation) or any criminal offense has occurred or is occurring, before they can stop or board a vessel. To further support this, the Mississippi Commission on Wildlife, Fisheries and Parks will create a "Mississippi Freedom Boater" safety inspection decal, which will be issued to vessels that meet safety requirements at the time of registration or renewal, signifying their compliance and potentially reducing the likelihood of future safety-focused stops. The bill also amends existing law to align with these new provisions.
