This bill allows for "supervised billing," which means that a qualified licensed healthcare provider can bill for mental health and substance abuse services provided by a qualified non-licensed provider who is actively working towards their license and is under the direct supervision of the licensed provider. This applies to both the state's Medicaid program, administered by the Department of Medical Assistance Services (DMAS), and private health insurance plans. For Medicaid, DMAS must permit this supervised billing, provided they receive necessary federal approvals and funding. For private health insurance carriers, they must cover these services when provided by a supervised non-licensed provider if they would be covered if provided by a licensed provider, and they must accept claims submitted by the supervising licensed provider. The bill also shortens the time frame for health insurance carriers to retroactively deny claims from 12 months to 180 days. The Medicaid provisions will expire on July 1, 2027, if federal approval and funding are not secured, and the provisions for both Medicaid and private insurance will apply to plans delivered, issued for delivery, or renewed on or after January 1, 2027.
