Bill Summary
This act would provide a rebuttable defense if any person shall die or sustain a personal injury while committing any violent criminal offense of a person if that individual is lawfully in a place they have a right to be, and acted in self-defense and in the reasonable belief that the person engaged in the criminal offense was about to inflict great bodily harm or death upon that person or any other individual. This act would take effect upon passage.
AI Summary
This bill would establish a "rebuttable defense," meaning it's presumed true unless proven otherwise, for individuals who cause death or injury to someone committing a violent criminal offense against a person, provided the person causing the harm was lawfully present and acted in self-defense, reasonably believing the offender was about to inflict great bodily harm or death. This defense applies even if the offender is injured or dies while committing certain enumerated offenses, such as burglary, or any violent criminal offense against a person, and it explicitly removes any duty to retreat from such an offender if the defender is lawfully in their location.
