This bill, a recommendation of the Boyd-Graves Conference, expands the circumstances under which an administrator can be appointed to handle legal actions related to a deceased person's estate. Previously, an administrator could only be appointed if a civil action for personal injury or wrongful death (a lawsuit for damages resulting from a death caused by negligence) was contemplated against or on behalf of the estate of a deceased resident or nonresident of the Commonwealth. This bill amends the law to allow for the appointment of an administrator not only for personal injury and wrongful death claims but also for civil actions involving property damage, provided the damage occurred within the Commonwealth, at least 60 days have passed since the decedent's death, and no executor or administrator has yet been appointed for the estate. The appointed administrator can then prosecute and defend these actions, including those for property damage.
