This bill, a recommendation from the Boyd-Graves Conference, expands the circumstances under which an administrator can be appointed for an estate. Currently, an administrator can be appointed to pursue or defend legal actions related to personal injury or wrongful death claims against or on behalf of an estate of someone who has died. This bill amends existing law to allow for the appointment of an administrator not only for personal injury and wrongful death claims but also for civil actions involving property damage that occur within the Commonwealth, regardless of whether the deceased was a resident or nonresident, or died within or outside the Commonwealth, provided at least 60 days have passed since their death and no other executor or administrator has been appointed. The appointed administrator will have the authority to prosecute and defend these types of actions, including property damage claims.
