This bill expands the ways a subpoena can be served on certain businesses, particularly for electronic records. Previously, serving a subpoena on a foreign corporation (a company incorporated outside of Virginia) that does business in Virginia had specific rules. This bill adds new methods for serving subpoenas for electronic records, electronically stored information, or other documents held by a non-party commercial enterprise (a business that is not directly involved in the lawsuit) that stores these records outside of Virginia. These new methods allow the subpoena to be served either within or outside of Virginia through personal delivery, certified mail, a commercial delivery service, fax, or electronically, in addition to the existing ways of serving legal documents. This change aims to make it easier to obtain necessary electronic records for civil and criminal cases when those records are held by businesses located elsewhere.
