Bill Summary
Civil actions; service of subpoena for certain electronic records. Provides that, in addition to methods for how service of process may be effected on certain corporations, any subpoena issued pursuant to a civil proceeding for electronic records, electronically stored information, or other documents or records that are stored outside of the Commonwealth by a nonparty commercial enterprise may be served within or outside of the Commonwealth by hand, certified mail, commercial delivery service, facsimile, or electronic means.
AI Summary
This bill expands the methods by which a subpoena can be served on a non-party commercial enterprise for electronic records or other documents stored outside of Virginia, provided that the enterprise is transacting or has transacted business in Virginia. In addition to existing methods for serving legal documents on corporations, this bill allows such subpoenas to be served within or outside of the Commonwealth through hand delivery, certified mail, commercial delivery service, facsimile, or electronic means. This change aims to simplify the process of obtaining electronic records from businesses that operate in Virginia but store their data elsewhere, which is particularly relevant in today's digital age where information is often stored remotely.
