This bill requires public safety employers, which are entities that employ individuals in roles focused on protecting people or property, enforcing laws, or preventing crime (such as law enforcement officers, firefighters, EMTs, and private security personnel), to provide employees and prospective employees with reasonable access to their complete employment records. This access specifically includes the results of any mental health evaluations or screenings conducted as a condition of employment. If a prospective employee is denied employment due to a mental health evaluation, they must be allowed to submit an alternative evaluation from a qualified mental health professional at their own expense, which the employer can then consider. Employees can sue their employer for violations of these access rights and may be awarded court costs and attorney fees if they win. All information provided under this bill remains subject to existing confidentiality laws.
