This bill establishes a new, expedited process for selling unclaimed vehicles that have liens against them, while also updating existing rules for vehicle keepers (defined as garage keepers, self-storage facilities, and tow truck drivers/operators) and mechanics. Key changes include allowing keepers to initiate the sale of a vehicle after it has been in their possession for 45 days with unpaid charges, provided they have sent proper written notice to the owner and any lienholders, and no one has responded within 20 days to reclaim the vehicle. Mechanics can also use this expedited process after their invoice goes unpaid for 15 days, provided they follow similar notice requirements. This new process, outlined in a new section (§ 46.2-644.05), allows for sales by public auction or private sale without requiring a court order, and provides immunity from civil liability for keepers and mechanics acting in good faith, except in cases of gross negligence or willful misconduct. The bill also clarifies that keepers and mechanics must retain documentation for at least five years and that the rights of bona fide purchasers or lienholders who pay outstanding charges before a sale are protected.
