This bill allows the town of Tiverton to require developers of low- or moderate-income housing to conduct additional testing, at their own cost, before construction begins to ensure that nearby existing or newly proposed wells are not negatively impacted. Specifically, this testing aims to detect any "dewatering" (lowering of the water table) or "loss of effective recharge" (reduced replenishment of groundwater) that could affect surrounding wells. If the testing reveals any adverse consequences, the developer will be solely responsible for eliminating or mitigating these problems to prevent serious harm or loss of water service to existing wells, with the town engineer or appointed personnel approving the proposed solutions. The testing must adhere to regulations from the Department of Environmental Management and the Department of Health, and the Department of Environmental Management may create further rules to implement these requirements.
