Violations of these identification and facial covering rules can result in criminal penalties, and officers found to have committed certain offenses while in violation may lose immunity and be liable for damages. The bill also creates a new criminal offense for unauthorized civil immigration arrest or detention, defined as a law enforcement officer acting beyond their authority to detain or arrest someone based solely on their civil immigration status without reasonable suspicion, which is defined as not being based on factors like race or national origin.
