This bill, effective July 1, 2026, prohibits the construction, modification, or expansion of any landfill unit, which refers to a municipal solid waste landfill unit or a construction and demolition landfill unit, or any part of it, within a designated "no-pass zone" in counties with over 500,000 residents. The "no-pass zone" is defined as areas above the freshwater aquifer that have a thin or nonexistent caprock, making them vulnerable to contamination, and these zones are identified by the Honolulu board of water supply using its Parcels and Zoning Information App. This prohibition aims to protect Oahu's freshwater aquifers from contamination, building upon previous legislation that established restrictions based on an "underground injection control line," and it includes an exemption for the continued operation of existing, properly permitted landfill units as long as no physical expansion requiring new permits is involved.
