This bill requires that anyone selling or providing emotional support animals, or those who issue documentation verifying a disability-related need for such an animal, must provide written notice to the buyer or recipient. This notice must clearly state that emotional support animals are not considered service animals under state law because they lack the required specialized training, and therefore, their users are not entitled to the same legal rights and privileges. The notice must also warn that falsely representing an animal as a service animal is illegal. Similarly, businesses selling certificates, vests, or identification tags for emotional support animals must also provide a written disclaimer informing buyers that these items do not qualify the animal as a service animal and do not grant any special legal rights. These written notices must be in at least twelve-point bold type and provided with the receipt or on a separate document attached to it. Violators will face fines, with penalties increasing for subsequent offenses, and this law does not prevent other legal actions for misrepresenting an animal as a service animal.
