Bill Summary

Prohibits lodging establishments from providing personal care products in small plastic containers within sleeping room accommodations, any space within sleeping room accommodations, or bathrooms used by the public or guests. Establishes civil penalties. Effective 7/1/3000. (HD1)

AI Summary

This bill prohibits lodging establishments, which are defined as places like hotels, motels, and vacation rentals that offer rooms for rent to the public, from providing personal care products such as shampoo, conditioner, or soap in small plastic containers, meaning bottles or containers of six ounces or less, within guest rooms or public bathrooms. This prohibition will be phased in, starting January 1, 2027, for larger establishments with over fifty rooms, and by January 1, 2029, for smaller ones with fifty or fewer rooms. Lodging establishments will still be allowed to offer these products in bulk dispensers or in containers made of non-plastic materials, but only if requested by a guest and provided outside of the guest room or public bathroom. The bill establishes civil penalties for violations, with a $500 fine for the first offense and $2,000 for subsequent offenses, and allows for daily penalties for continued violations, with the attorney general able to pursue these penalties in court. The bill also clarifies that counties can enact stricter regulations and that the Department of Health may adopt rules to implement these changes, with the entire act set to take effect on July 1, 3000.
