Bill Summary

Expands the protections established under Act 2, SLH 2023, to include gender-affirming health care services, including clarifying permitted disclosures of protected health information to address changes in federal regulations. Establishes protections against abusive litigation. Prohibits medical malpractice insurers and health carriers from taking certain adverse actions against health care providers solely on the basis that the health care provider provides lawful reproductive health care services or gender-affirming care services. Effective 7/1/3000. (HD1)

AI Summary

This bill expands protections for gender-affirming health care services, similar to existing protections for reproductive health care services, by prohibiting abusive litigation against individuals or entities providing or seeking these services, and preventing medical malpractice insurers and health carriers from taking adverse actions against healthcare providers solely for offering these lawful services. It also clarifies rules regarding the disclosure of protected health information (PHI), ensuring that such information related to lawful reproductive or gender-affirming care is not used for investigations or to impose liability, while still allowing for disclosures in specific, legally defined circumstances with proper attestations. Furthermore, the bill amends various professional licensing laws to ensure that disciplinary actions against healthcare providers are not based on the provision of lawful reproductive or gender-affirming care, and it strengthens protections against the enforcement of out-of-state laws that would penalize such care.
