This bill amends existing Idaho law to establish new provisions for fingerprint screening by certain entities. Specifically, it clarifies that government entities and legislative agencies requiring fingerprinting can submit these to the bureau for examination and forwarding to the Federal Bureau of Investigation (FBI), making the bureau the sole state source for such submissions for criminal justice and licensing purposes. It also introduces a new section that authorizes private, non-criminal justice entities that qualify under federal acts like the National Child Protection Act of 1993 and serve vulnerable populations (children, the elderly, and individuals with disabilities) to submit fingerprints for criminal history record checks. These "qualified entities" will be responsible for screening individuals, including employees, contractors, and volunteers, who have or may have access to these vulnerable populations, and the bill outlines the process for notification to individuals being screened about their rights to obtain and challenge their background reports, as well as the associated fees. The bill also includes an emergency clause, making its provisions effective on July 1, 2026.
