Bill Summary

This bill prohibits a county from preventing an industrial or commercial business that operates or seeks to operate the business on and out of property in the county but outside the corporate limits of any city from storing items directly related to the business, regardless of zoning designation, when all of the following conditions are met: the business (1) uses a building to store the items; (2) does not have more than one location in the county located outside the corporate limits of any city; (3) is independently owned and operated; (4) does not have more than 30 employees; and (5) owns the property from which it is operating and at which it is storing items.

AI Summary

This bill establishes a new section of law that prevents counties from using zoning regulations to stop certain industrial or commercial businesses from storing items related to their operations, even if the storage doesn't fit the current zoning rules. This applies to businesses operating outside of city limits. However, this exemption only applies if the business meets five specific criteria: it must store items within a building, have only one location in the county outside of any city, be independently owned and operated, employ no more than 30 people, and own the property where it operates and stores items. The "corporate limits of any city" refers to the official boundaries of a municipality.
