This bill amends existing Idaho law to allow certain cottage food operations, defined as businesses making sales of $5,000 or less in a year, to sell "time/temperature control for safety foods" (TCS foods) directly to consumers. TCS foods are those that require refrigeration or other temperature controls to prevent the growth of harmful bacteria, such as dairy products, cooked meats, and certain prepared salads. Previously, these types of foods were generally prohibited for sale by cottage food operations, which are typically small, home-based businesses that produce food items for sale. The bill also declares an emergency and sets an effective date of July 1, 2026.
