This bill prohibits any person from falsely impersonating an employee organization representative, which is defined as an employee, staff member, or agent of an employee organization, an elected or appointed official within an employee organization, or a public employee designated by the exclusive representative to represent employees in a bargaining unit. Falsely impersonating means using fraud, misrepresentation, or deceit to make a communication that appears to be authorized by an employee organization when it is not. If a violation occurs, an employee organization can file a civil lawsuit seeking an injunction, damages (including punitive damages), or other relief, and will also receive a set amount of liquidated damages per incident.
