This bill relates to the purchase or sale of an individual including surrogate mother agreements. The bill provides that the prohibition against the purchase or sale of an individual does not apply to a surrogate mother arrangement provided that the surrogate mother receives no monetary consideration or anything of value for agreeing to be artificially inseminated to bear a child and to relinquish all rights regarding that child to another person or couple. A person violating the bill is guilty of a class “C” felony. A class “C” felony is punishable by confinement for no more than 10 years and a fine of at least $1,370 but not more than $13,660.
