This bill, amending West Virginia law, aims to prohibit the online distribution of material harmful to minors by requiring commercial entities that publish or distribute such content on their websites to verify that individuals attempting to access it are at least 18 years old. "Material harmful to minors" is defined as descriptions or representations of nudity, sexual conduct, sexual excitement, or sadomasochistic abuse that appeal to a minor's prurient interest, are patently offensive by adult community standards for minors, and lack serious value for minors. Commercial entities must use a commercially available database or another reasonable method for age and identity verification. Failure to comply can result in civil liability for damages and legal costs. Importantly, the bill clarifies that providers or users of "interactive computer services," which are defined as systems providing internet access to multiple users, will not be held liable under these provisions.
