This bill amends a South Dakota law to clarify the transportation requirements for inmates being released from correctional facilities. Previously, the law stated that correctional officials "shall provide every inmate with suitable clothing, a sum of money to be determined by the secretary of corrections, and transportation to the place where the inmate received sentence." This bill changes the language to "must provide the inmate with the following, if not already provided: (1) Suitable clothing; (2) A sum of money to be determined by the secretary of corrections; and (3) Transportation to one of the following locations: (a) The county where the inmate resided at the time of the offense that resulted in imprisonment; (b) The county where the inmate received sentence; or (c) A location equivalent in distance to either subsection (a) or (b), whichever is lesser in mileage." This revision specifies that the transportation must be provided "upon discharge of an inmate from a correctional facility, whether by parole, suspended sentence, or final discharge," and it expands the options for the destination county to include the inmate's county of residence at the time of the offense, in addition to the county where they received their sentence, or a location of equivalent distance.
