This bill amends Virginia law to prohibit the consumption or possession of open containers of marijuana or alcoholic beverages in the passenger area of a motor vehicle. Specifically, it clarifies that "passenger area" refers to the driver's seating area, areas within the driver's reach, and passenger seating, but excludes the trunk, areas behind the last seat in certain vehicles, living quarters of motor homes, and the passenger area of vehicles used for public transportation. The bill also adds that if the seal on a container of marijuana or alcoholic beverages is broken or some contents are removed, the container is presumed to be open. Furthermore, it modifies existing provisions regarding deliveries of alcoholic beverages to state that such beverages, when delivered, cannot be stored in the passenger area of a vehicle, referencing federal definitions for "passenger area" (23 U.S.C. §§ 154(a)(4) and (b)(2) and 23 C.F.R. § 1270.3(g)). Finally, it directs that a portion of federal highway funds be deposited into Virginia's Highway Safety Improvement Program.
