This bill amends Title 11 of the Delaware Code to establish a new section, § 1103F, defining and penalizing "Child abuse by a person in a position of trust, authority, or supervision in the first degree." This new law outlines various scenarios that constitute this offense, including intentionally or recklessly causing serious physical injury that results in permanent disfigurement or loss of bodily function, causing serious physical injury, causing physical injury to a child under six years old or a child with a disability, or causing injury with a deadly weapon. It also clarifies that it is not a defense if the abuser was unaware of the child's age or disability. The bill then assigns felony classifications and corresponding penalties to each of these offenses, ranging from Class A for the most severe injuries to Class F for actions likely to be injurious to a child's welfare, and explicitly states that these charges do not prevent separate convictions for other crimes.
