This bill amends existing Idaho law to revise and clarify which flags can be flown by governmental entities, which are defined as state agencies or local political subdivisions like counties and cities, but not schools or universities. It expands the types of flags allowed to include official city or county flags and flags of recognized Indian tribes, and permits flags of foreign countries to commemorate special occasions, with an exception for countries engaged in hostile action with the U.S., and specifically allows the Basque autonomous community flag. The bill also adds a provision for colleges and universities to fly exactly one official flag if designated by policy. Importantly, it introduces a penalty of $2,000 per day for each flag displayed in violation of these rules, and grants the Attorney General the authority to enforce these provisions through civil action, including recovering attorney fees if successful, after providing a notice and an opportunity to correct the violation.
