This bill amends existing Arizona law regarding referral agencies that connect individuals with assisted living facilities and assisted living homes, which are places that provide housing and care for people who need some help with daily activities. The bill requires these referral agencies to clearly disclose to prospective residents or their representatives any business or financial relationships they have with the facilities they recommend, and to state the fee the facility will pay the agency for the referral, which can be a dollar amount or a percentage of the resident's first month's rent and care charges. Referral agencies must also obtain an acknowledgement from the prospective resident that they received this disclosure, and residents have the right to terminate the agency's services at any time, though the agency may still be owed a fee under specific circumstances related to prior referrals. Furthermore, the bill mandates that assisted living facilities must notify referral agencies of resident admissions within fourteen days, and the referral agency must then provide the facility with a copy of the disclosure and the resident's acknowledgement, along with proof that the agency is not on the adult protective services registry. Importantly, referral agencies are now required to carry specific insurance, including at least $1 million in commercial general liability and professional liability insurance per occurrence, and $3 million in aggregate for both. Violations of these provisions can result in civil penalties of up to $1,000 per violation.
