This bill allows the Secretary of Public Education, who is responsible for overseeing and enforcing laws related to public schools, to take action against local school board members who are not fulfilling their duties. If the Secretary has a valid reason to believe a school board member is intentionally failing to perform a required duty, the Secretary must first provide written notice to the member, detailing the specific failures and requiring them to take corrective steps, known as remedial action, within at least thirty days. If the member fails to take this required remedial action, the Secretary then has the authority to suspend the member from their position until they comply. The bill also outlines procedures for notifying the suspended member, including the reasons for the suspension, how to get reinstated, and their right to request a hearing to challenge the suspension, with the option to appeal any unfavorable decision. Importantly, during a suspension, the Secretary or their appointee can only step in to vote on the school district's annual budget if there's a tie.
