Bill Summary

Amends the Community Mental Health Act. In provisions concerning the appointment of members to a community mental health board, provides that whenever there is a vacancy in the board's membership for a period of 60 days prior to the expiration of the term or for more than 60 days after the expiration of the term, any member of the governing body may nominate a qualified candidate to fill such vacancy. Provides that if the governing body votes to reject a nominated candidate or takes no action on a candidate's nomination, twice, then the candidate is prohibited from appointment to the community mental health board for a period of one calendar year. Permits a community mental health board member to continue to serve on the board after the expiration of his or her term until a successor is appointed and approved by a majority vote of the governing body. In provisions concerning the removal of community mental health board members, provides that prior to filing the vacancy created by the removal of a member of the community mental health board, the full membership of the governing body may vote to override the appointing officer's removal of a member of the community mental health board with an 80% vote of the governing body required to override the removal.

AI Summary

This bill modifies the process for removing a member from a community mental health board, which is a group responsible for overseeing mental health services in a specific area. Currently, a board member can be removed for reasons like excessive absence or misconduct. The bill adds a requirement that before a removal can happen, the board member must be given a chance to speak to the entire governing body of the authority that appointed them. After this hearing, the member can only be removed if two-thirds of the entire governing body votes for removal during a public meeting.
