Bill Summary

AN ACT To amend Code Section 44-13-100 of the Official Code of Georgia Annotated, relating to exemptions for purposes of bankruptcy and intestate insolvent estates, so as to revise the exemption for a debtor's aggregate interest in real property or personal property that the debtor or a dependent of the debtor uses as a residence, in a cooperative that owns property that the debtor or a dependent of the debtor uses as a residence, or in a burial plot; to provide for such exemption for the primary residence of spouses; to provide for certain increases to such exemption; to provide for related matters; to repeal conflicting laws; and for other purposes.

AI Summary

This bill revises the amount of property that debtors can protect from creditors in bankruptcy or when they pass away with debts, specifically focusing on their primary residence. Currently, a debtor can exempt up to $21,500 of their interest in their home or other residential property, or $43,000 if the property is jointly owned by spouses and is their primary residence. This bill proposes to increase these exemptions to $50,000 for individual debtors and $100,000 for married couples whose primary residence is jointly owned. Furthermore, starting in July 2031, these exemption amounts will be adjusted annually to account for inflation, using a method determined by the state revenue commissioner, which may involve using the Consumer Price Index or a similar federal index to reflect changes in the cost of living. The bill also clarifies that the term "inflation rate" refers to the annual inflationary index rate determined by the state revenue commissioner.
