This bill establishes statewide standards to limit the participation of state and county agencies, their employees, and recipients of state funds in civil immigration enforcement activities within or near "protected community locations," which are defined as places that provide state-funded services related to education, health, social services like shelter or food assistance, or access to justice, including schools, hospitals, libraries, shelters, and places of worship, as well as a one-thousand-foot "protected perimeter" around them. The bill prohibits these "state actors" from assisting with civil immigration enforcement in these areas unless required by federal or state law or a judicial warrant, which is a warrant issued by a judge based on probable cause, not an administrative warrant or an immigration detainer. It also prevents state actors from providing access to nonpublic areas of these locations for immigration enforcement, collecting or disclosing immigration-related information, or facilitating interviews or surveillance for such purposes, with exceptions for imminent threats to life or safety, executing judicial warrants, or performing duties unrelated to immigration enforcement. Key state agencies, including the Department of Education, University of Hawaii, and Hawaii Health Systems Corporation, are required to adopt and post written policies, provide annual staff training, and maintain data privacy protections, with the Attorney General's office responsible for investigating violations, imposing civil penalties, and providing model policies and training materials, and funds are appropriated for the Attorney General's implementation efforts.
