This bill requires the Director of Business, Economic Development, and Tourism (DBEDT) to implement a mandate that, by January 1, 2028, diesel fuel sold for use in on-highway diesel-powered motor vehicles in counties with populations between 200,000 and 300,000 must contain at least five percent biodiesel by volume, with an exception for situations where biodiesel supply is insufficient, in which case renewable diesel can be used. Biodiesel is defined as a liquid fuel derived from organic sources like agricultural residues, animal waste, biomass crops, food wastes, oil crops, and sewage or landfill wastes, provided it meets the ASTM International standard D6751. Violators face fines of at least $2 per gallon of non-conforming fuel, up to a maximum of $10,000 per infraction. DBEDT must also submit a comprehensive rollout plan to the Legislature by early 2027, detailing the timeline, financial and administrative aspects, coordination with the Department of Transportation, and any necessary regulatory changes, and this plan must be presented to the public at least 120 days before the requirement takes effect.
