This bill requires that any program offering electric scooters for short-term public rental, whether run by a city agency or a private company authorized by one, must register each electric scooter annually with the department, which will include a safety inspection focusing on mechanical integrity and battery safety. Operators of these programs will also have to pay a fee, determined by the commissioner, which will go into a newly established "street and sidewalk infrastructure fund." This fund, jointly managed by the comptroller, commissioner of taxation and finance, and commissioner of transportation, will be used by the department of transportation for projects aimed at repairing, maintaining, and improving streets, sidewalks, and related pedestrian infrastructure. Furthermore, operators must maintain a 24/7 system to address improperly parked scooters, with penalties, including fines or registration suspension, for non-compliance, and enhanced penalties for scooters blocking accessible routes as defined by the Americans with Disabilities Act. The commissioner of transportation will also be required to report annually on how the funds were used.
