Bill Summary

This bill requires a public or private employer to establish a workplace policy that provides an employee the right to disconnect from communications from the employer during nonworking hours. The bill defines the right to disconnect to mean that, except for an emergency or for scheduling, as defined, an employee has the right to ignore communications from the employer during nonworking hours. Further, the bill requires nonworking hours to be established by written agreement between an employer and employee. An employee may file a complaint of a pattern of violation with the Commissioner of Labor and Workforce Development. A pattern of violation is punishable by a fine of not less than $100.

AI Summary

This bill requires public and private employers to create workplace policies that grant employees the "right to disconnect," meaning they can ignore employer communications during their "nonworking hours," which are defined as time outside of their agreed-upon work schedule. Exceptions to this right exist for emergencies, defined as unforeseen situations threatening people or operations, and for scheduling changes made within 24 hours. These nonworking hours must be established through a written agreement between the employer and employee, and the policy cannot reduce existing worker rights, such as compensation or time off. Employees can report a "pattern of violation," defined as at least three documented instances of the employer disregarding this right, to the Commissioner of Labor and Workforce Development, who can then impose a fine of at least $100. This bill does not apply to employees covered by a collective bargaining agreement and will take effect six months after being enacted.
