Bill Summary

This bill provides that any order, rule, or regulation issued by the Governor pursuant to the "Civil Defense and Disaster Control Act" will terminate on the 31st day after issuance, unless the Legislature approves a greater period of time by way of concurrent resolution. The concurrent will have to pass with an affirmative vote of two-thirds of the authorized membership of each House. The bill prohibits the Governor from issuing an order, rule, or regulation to the same or substantially same effect as one terminated pursuant to the bill for the same emergency. The bill does not apply to orders, rules, or regulations: (1) rescinding an order, rule, or regulation issued pursuant to the "Civil Defense and Disaster Control Act"; (2) issued pursuant to direction by or agreement with the federal government, in compliance with federal law, or to the extent that application of the bill would jeopardize the receipt of federal funds by the State; (3) applying exclusively to the executive branch; (4) issued under the Governor's authority as the Commander-in-Chief of the military and naval forces of the State; or (5) issued pursuant to a provision of law providing for a greater period, notwithstanding that the order, rule, or regulation may also cite to an authority provided under the "Civil Defense and Disaster Control Act."

AI Summary

This bill establishes a 30-day limit for emergency orders, rules, or regulations issued by the Governor under the "Civil Defense and Disaster Control Act," a law that provides the Governor with broad powers during emergencies. Unless the Legislature, by a two-thirds vote in both houses through a concurrent resolution, approves a longer duration, these emergency measures will automatically expire after 30 days. Furthermore, the Governor is prohibited from reissuing an order with the same or very similar effect for the same emergency once it has expired. However, this limitation does not apply to orders that revoke previous ones, those required by federal law or agreements that could jeopardize federal funding if not followed, measures solely affecting the executive branch of state government, actions taken by the Governor as Commander-in-Chief of the state's military forces, or any emergency measure already authorized by another law for a longer period.
