Bill Summary

This bill requires restitution to be paid to a child of a parent or guardian who is killed by a drunk driver. Under current law, a court is required to order a defendant to make restitution if a victim has suffered a loss and the defendant is able to pay or, given a fair opportunity, will be able to pay. This bill requires restitution to be paid to the child of a parent or guardian who was killed by a drunk driver. In addition to other factors to be considered by the court when ordering restitution, this bill requires the court to specifically consider the loss of financial support to a child whose parent or guardian was killed by a drunk driver until the child reaches 18 years of age or, if the child is disabled, until the child reaches 21 years of age. However, any restitution ordered for a child under the bill is to be for the loss of financial support for the child over a period of not less than five years.
