Bill Summary

This bill prohibits automobile insurers from using underwriting rules to raise automobile insurance rates on persons who are deemed not at fault when their vehicle is involved in a motor vehicle accident with a municipal vehicle. Under the bill, automobile insurers will be prohibited from using underwriting rules to assign a risk to a rating plan on the basis of the named insured's involvement in a motor vehicle accident in which: (a) the named insured is a private individual deemed not at fault by the insurer providing coverage to the named insured at the time of the accident; and (b) the at fault party involved in the accident is a municipality subject to immunity.

AI Summary

This bill prohibits automobile insurers from using their underwriting rules, which are the guidelines they follow to determine insurance rates and decide who to insure, to increase insurance premiums for individuals who are not at fault in a car accident involving a municipal vehicle. Specifically, insurers cannot assign a higher risk to a policyholder in their rating plan if the accident involved a municipality that has legal immunity (meaning it cannot be easily sued) and the individual was deemed not at fault by their own insurer. This provision aims to protect individuals from facing higher insurance costs when an accident is caused by a government entity that may be shielded from full responsibility.
