This bill establishes a new "Opioid Prevention and Rehabilitation Program Fund" to support substance use disorder treatment for individuals who are uninsured, underinsured, or on Medicaid. To fund this program, a tax of one cent per milligram of active opioid ingredient will be levied on the first wholesale distribution of opioid drugs within the state. The terms "distribution," "drug," and "wholesale distributor" will carry the same definitions as established in current law concerning the licensing of pharmaceutical wholesale distributors, meaning it applies to the initial sale of these drugs by licensed distributors within the state. This tax revenue will be deposited into the dedicated fund, and the Legislature will annually allocate these monies to the Department of Human Services for treatment programs. The bill takes effect immediately, but the tax will apply to wholesale distributions of opioid drugs starting on the first day of the second calendar quarter after the bill is enacted.
