Bill Summary

This bill provides that it is aggravated assault to commit a simple assault against certain civil investigators. Under the provisions of the bill, a person commits aggravated assault by committing simple assault against a civil investigator employed by a State department or agency who clearly is identifiable as acting in the performance of the investigator's duties, or while exhibiting evidence of authority, or because of the investigator's status as a civil investigator. Current law provides for an upgrade from simple assault to aggravated assault against certain professionals acting within the scope of their duties including, but not limited to, law enforcement officers, Supreme Court justices, Superior and Tax Court judges, employees of the Department of Corrections, utility workers, and healthcare workers. This bill provides that State-employed civil investigators are afforded a similar protection.
