This bill prohibits the sale, distribution, or offering for sale of menstrual products in New Jersey that contain "intentionally added PFAS," which refers to perfluoroalkyl and polyfluoroalkyl substances (PFAS) that are deliberately added to a product or its components to achieve a specific characteristic, appearance, quality, or function, and includes any byproducts of these substances, but excludes trace amounts that are unavoidable. The bill defines "menstrual product" broadly to include items like tampons, pads, discs, menstrual cups, and underwear, whether disposable or reusable. Manufacturers will be required to establish a system for periodically testing their menstrual products for these intentionally added PFAS, using laboratories approved by the Department of Environmental Protection, and the results will be accessible to the Department of Health. Violations of these provisions will be considered unlawful practices, subject to penalties under New Jersey's existing consumer protection law. The law is set to take effect 25 months after enactment, allowing time for administrative preparations.
