Bill Summary
This bill updates current law by establishing that a quorum exists for the sole purpose of processing applications for licensure with majority of the members present at a meeting of a professional board, committee or other entity, overseen by the Division of Consumer Affairs in the Department of Law and Public Safety or other State agency. This includes a meeting with two members in attendance if one of those members is the chair of the entity. This quorum standard is applicable to applications that do not require legal review due to adverse information in any statutorily-required criminal history record background check and if after a 90-day period, the entity is: (1) unable to achieve a quorum due to vacancies in the membership of the entity; or (2) only able to achieve a quorum if every current member of the entity is present for each meeting.
AI Summary
This bill establishes new quorum standards for professional licensing entities, which are overseen by the Division of Consumer Affairs in the Department of Law and Public Safety or other state agencies, specifically for the purpose of processing applications for licensure that do not involve adverse information from a criminal history record background check. A quorum, which is the minimum number of members required to conduct official business, will now be met by a majority of members present at a meeting, even if only two members are in attendance, provided one of them is the chair of the entity. This relaxed quorum requirement applies only if, after a 90-day period, the entity cannot achieve a quorum due to member vacancies or if a quorum can only be formed when every single current member is present.
