This bill amends existing Idaho law to revise provisions related to enticing a child through the internet or other communication devices. Specifically, it clarifies that the law applies to individuals eighteen years of age or older who knowingly use the internet or any communication device to solicit, seduce, lure, persuade, or entice a child to engage in any sexual act that violates specific chapters of Idaho Code. The bill also defines "child" to include persons under sixteen years of age, or those sixteen or seventeen years of age if the perpetrator is at least five years older, and makes technical corrections to the existing statute. It also clarifies that it is not a defense if law enforcement was involved in the investigation and that the actual occurrence of a sexual act is not necessary to prove a violation. The bill declares an emergency and sets an effective date of July 1, 2026.
