Bill Summary
This bill prohibits the Board of Public Utilities (board) from retiring, or otherwise recommending, incentivizing, or authorizing the retirement of, a covered facility unless the board has identified one or more replacement facilities that can meet the demand served by the covered facility and become operational in a timely manner. However, the bill's provisions do not prohibit the board from retiring, or otherwise recommending, incentivizing, or authorizing the retirement of, a covered facility that is no longer functional or that threatens public health and safety. Under the bill, "covered facility" means an electric generation facility in the State that is connected to the electric grid serving New Jersey; and "replacement facility" means an electric generation facility in the State that produces electricity solely through renewable energy sources, including, but not limited to, thermal, wind, hydropower, and nuclear, and that is connected to the electric grid serving New Jersey.
AI Summary
This bill prohibits the New Jersey Board of Public Utilities (BPU), referred to as the "board," from shutting down or approving the shutdown of an electric generation facility connected to the state's grid, termed a "covered facility," unless they have secured at least one new "replacement facility" that can generate enough electricity to meet the demand and be ready to operate in a timely manner to avoid any significant power shortage. A "replacement facility" is defined as an electric generation facility in New Jersey that produces electricity exclusively from renewable energy sources, such as solar, wind, hydropower, and even nuclear power, and is also connected to the state's electric grid. However, this restriction does not apply if a "covered facility" is no longer working or poses a threat to public health and safety.
